Welcome to MDH Asphalt & Excavation. These Terms of Service ("Terms") govern your use of our website and the services we provide. By using our services, you agree to these terms.
1. Service Agreement
MDH Asphalt & Excavation provides asphalt paving, excavation, and related services throughout Cape Cod, Massachusetts. All services are subject to a written contract that outlines specific terms, pricing, timeline, and scope of work.
2. Estimates and Pricing
- All estimates are provided free of charge and are valid for 30 days unless otherwise specified
- Final pricing may vary based on site conditions, material costs, and project scope changes
- Written approval is required for any changes that affect the original estimate
- Payment terms will be specified in the service contract
3. Project Timeline and Weather
Project timelines are estimates and may be affected by weather conditions, permit delays, or unforeseen site conditions. Asphalt paving cannot be performed in temperatures below 50°F or during precipitation. We will reschedule work as needed to ensure quality results.
4. Property Access and Preparation
- Customer must provide clear access to the work area
- Vehicles, equipment, and personal property must be removed from the work area
- Utility lines must be marked by Dig Safe before excavation work begins
- Customer is responsible for any damage to unmarked utilities
5. Limitation of Liability
MDH Asphalt & Excavation's liability is limited to the cost of the services provided. We are not responsible for indirect, consequential, or incidental damages. We maintain appropriate insurance coverage for our operations.
6. Payment Terms
- Payment terms will be specified in each service contract
- Final payment is due upon completion of work
- Late payments may incur interest charges as specified in the contract
- We accept cash, check, and major credit cards
7. Cancellation Policy
Projects may be cancelled with 48-hour notice without penalty. Cancellations with less than 48-hour notice may incur charges for materials already ordered or mobilization costs.
8. Permits and Regulations
Customer is responsible for obtaining necessary permits unless otherwise agreed in writing. All work will be performed in compliance with local building codes and regulations.
9. Dispute Resolution
Any disputes will be resolved through good faith negotiation. If necessary, disputes will be handled through mediation or arbitration in Massachusetts courts according to Massachusetts law.
10. Changes to Terms
We reserve the right to modify these Terms of Service at any time. Changes will be posted on our website and take effect 30 days after posting.
